Procurement Subject: Real Estate acquired by purchase for use as the premises of The Taipei Economic & Cultural Offices in San Francisco (TECO in San Francisco)

2. GENERAL REQUIREMENT:
The Taipei Economic and Cultural Office in San Francisco is interested in purchasing approximately 41,200 square feet of office space.
3. UNIQUE REQUIREMENTS:
- The building offered must be officially classified as suitable for use as offices by the Taipei Economic and Cultural Offices in San Francisco.
- Contiguous space is preferred for office condominium options.
- Space is required to be on no more than ten floors, but fewer floors are preferred.
- Parking for at least twelve (12) cars is preferred.
- Easy access for vehicles and pedestrians is preferred.
4. GEOGRAPHIC DELINEATED AREA:
Space must be within the following delineated area:
Northern Boundary: Golden Gate Bridge
Eastern Boundary: San Francisco Bay
Southern Boundary: Daly City BART station
Western Boundary: Great Hwy
5. USE OF SUBJECT REAL ESTATE:
The land, and building(s) attached to it, shall be officially classified as suitable for use as offices by The Taipei Economic and Cultural Offices in San Francisco. If it remains necessary to apply for a change in land-use zoning for the land and/or building(s) to be used as an office, the procuring Entity may, depending on the circumstances of the case, apply one of the following contractual conditions: (a) A sale and purchase contract maybe signed that sets the prerequisite the federal/local government shall agree to split, transfer or change the land-use zoning in order for the property rights to be registered and transferred to the TECO in San Francisco. Such contract, however, shall also expressly specify that if the federal/local government does not agree to split, transfer or change the land-use in order for the property rights to be registered and transferred to the TECO in San Francisco, the contract then is invalidated. (b) As soon as the federal/local government agrees to split, transfer or change the land-use, then the Sale and Purchase Contract for the Subject real Estate will be entered into. If the length of time taken by the federal/local government to agree to split, transfer or change the land-use is such that difficulties are experienced in obtaining relevant budget for the purchase of the Subject Real Estate, then the contract is invalidated.
6. SUBMISSION:
Expressions of interest must be submitted in writing no later than 05:00 PM, Thursday, September 15, 2022 (Pacific Time) and should include three (3) copies of the requested documents described in the attachment.
Submission by other than the owner or manager of a property must be accompanied by a letter from the ownership granting permission to make a general offering of space.
The procuring entity may request the Tendering Entity to cooperate in any field investigation of the Subject Real Estate. Base on review of the documents submitted by the Tendering Entity, the Procuring Entity can call on the Tendering Entity for any explanation the Procuring Entity deems required.
If there is any question or dispute involving the Subject Real Estate, such as obligations under a lease, property rights (such as pre-emptive rights), eviction issues/occupation by others, mortgages, priorities, or any other outstanding issues or claims, the Tendering Entity is responsible for resolving any such hindrance before the deadline required by the Procuring Entity and the Tendering Entity should bear the costs of such.
7. AWARD OF THE CONTRACT:
The Award of the Contract will be made according to the “Regulation for Evaluation of the Most Advantageous Tender”. The price negotiation and award methods to be applied to tenders that are reviewed and identified as being suitable for the acquisition shall be as follows:
(a) When there is only one Tender suitable for the acquisition, the price negotiation method will be applied.
(b) When there are more than two Tenders suitable for the acquisition, the price negotiation method will be applied in sequence starting with the Tender deemed most suitable for the acquisition. When there are two or more equally suitable Tenders, the price negotiation method will be applied in sequence starting with the Tender with the lowest bid price.
(c) The number of price reductions is limited to a maximum of three (3) for each Tender in sequence of price negotiation.
8. CONTRACT PERFORMANCE PERIOD:
The Tendering Entity winning the award shall hand over the Subject Real Estate within three (3) months after the Sale and Purchase Contract for the Subject Real Estate has been signed. In the case where it remains necessary to apply for a change of the land-use zoning or the permitted use of the Subject Real Estate, the three (3) month period will start after the local government has agreed to split, transfer or change the land-use zoning.

Entity to accept and handle request for clarifications or complaints: the Procuring Entity.
The period for a Tendering Entity to file a request for clarification to the Procuring Entity seeking explanation and/or clarification of the content of the Tender Solicitation Documents is one quarter of the tendering period starting from the date of publication or invitation to tender, with any segment of less than one day to be counted as one full day.
10. AUTHORIZED CONTACTS:
In no event shall the Offeror enter into negotiations or discussions concerning the space to be sold with representatives of any agency other than the officers and employees of The Taipei Economic and Cultural Office in San Francisco or their authorized representative, Cushman & Wakefield.
