Taiwan’s lack of State Party status under the International Health Regulations leads to notification concerning a Taiwanese national’s inflight exposure to tuberculosis being sent to China

1. After the World Health Organization implemented the revised International Health Regulations in 2005, China issued a statement claiming that its IHR jurisdiction would also cover Taiwan, Hong Kong, and Macau, while designating its National Health Commission as its IHR National Focal Point (NFP).

2. To keep pace with international practices and prevent suppression by China, Taiwan voluntarily implemented the IHR (2005) in May 2006. The Centers for Disease Control of Taiwan’s Ministry of Health and Welfare was designated as its IHR NFP. The email account ihrfocalpoint@cdc.gov.tw was set up as a channel of communication with the IHR NFP network and the epidemic information contact points of other countries, the WHO Western Pacific Regional Office (WPRO), and the Program for Monitoring Emerging Diseases, to facilitate information-sharing during disease outbreaks and notifications regarding inflight exposure to communicable diseases. Although this email address has not been confirmed by the WHO WPRO, Taiwan’s CDC uses it extensively to exchange disease information with other countries, including Australia, Canada, China, Hong Kong, Japan, Singapore, the United States, and Vietnam, as well as the European Union.

3. Taiwan was formally included in the WHO’s IHR mechanism in January 2009. The CDC and the WHO headquarters have jointly established a contact point for direct communications with each other. The CDC is also able to access the IHR Event Information Site to obtain information on international public health events, as well as the IHR NFP contact details of other countries. However, the CDC’s contact details are not published on the IHR website on the grounds that Taiwan is not a WHO member. As a result, when the WPRO IHR contact point received a notification from the IHR NFP of a certain country concerning a Taiwanese national who had been subject to inflight exposure to H1N1, it forwarded the information to China’s IHR NFP to be relayed to Taiwan’s CDC.

4. A more recent case involved China’s IHR NFP receiving a notification from a certain country regarding the inflight exposure of a Taiwanese national to tuberculosis in October 2017. It was not until five months later, in March 2018, that Taiwan’s CDC was informed by China’s Center for Disease Control and Prevention, a significant delay. If there were to be another outbreak of a communicable disease like SARS, the health of people in Taiwan, as well as all other people around the world, would be jeopardized.

5. We urge all countries to take prompt action to demand that the WHO rectify the situation, and publish Taiwan’s IHR NFP details using a name and means acceptable to Taiwan.
